Mahkeme, al\u0131nan hizmet bedelinin hukuka ayk\u0131r\u0131 oldu\u011funa h\u00fckmetti.<br \/>\n<br \/>T\u00fcketici Etik De\u011ferler Federasyonu Genel Ba\u015fkan\u0131 Ali \u0130hsan Nazl\u0131, s\u00fcre\u00e7 hakk\u0131nda yapt\u0131\u011f\u0131 a\u00e7\u0131klamada, &#8220;Bir vatanda\u015f, e-Devlet \u00fczerinden yapt\u0131\u011f\u0131 bin 500 TL\u2019lik HGS y\u00fcklemesi s\u0131ras\u0131nda, Posta ve Telgraf Te\u015fkilat\u0131 (PTT) taraf\u0131ndan 20 TL komisyon kesildi\u011fini fark etti. Bu durumu kabul etmeyen t\u00fcketici, hak aray\u0131\u015f\u0131 i\u00e7in T\u00fcketici \u0130l Hakem Heyeti\u2019ne ba\u015fvurdu. Hakem heyetinde lehine karar \u00e7\u0131kan vatanda\u015f, Posta ve Telgraf Te\u015fkilat\u0131\u2019n\u0131n karara itiraz ederek davay\u0131 Rize 4. Asliye Hukuk Mahkemesine ta\u015f\u0131mas\u0131 \u00fczerine s\u00fcreci devam ettirdi. Mahkeme, 5464 say\u0131l\u0131 Banka Kartlar\u0131 ve Kredi Kartlar\u0131 Kanunu\u2019nun 17. maddesi gere\u011fi, kart hamillerinden herhangi bir komisyon al\u0131namayaca\u011f\u0131n\u0131 belirterek t\u00fcketici lehine karar verdi. Mahkeme, al\u0131nan hizmet bedelinin hukuka ayk\u0131r\u0131 oldu\u011funa h\u00fckmetti&#8221; dedi.<br \/>\n<br \/>Nazl\u0131, \u201cHakk\u0131n\u0131 arayan bu de\u011ferli t\u00fcketicimizi ve haks\u0131zl\u0131klar kar\u015f\u0131s\u0131nda sessiz kalmayarak haklar\u0131n\u0131 savunan t\u00fcm vatanda\u015flar\u0131m\u0131z\u0131 tebrik ediyoruz. Bu \u00f6rnek, bilin\u00e7li t\u00fcketici davran\u0131\u015f\u0131n\u0131n \u00f6nemini bir kez daha g\u00f6stermi\u015ftir.
