Manisa Celal Bayar \u00dcniversitesi \u015eehit Prof. Dr. \u0130lhan Varank Yerle\u015fkesinde d\u00fczenlenen bas\u0131n a\u00e7\u0131klamas\u0131na Memur Sen Manisa \u0130l Temsilcisi ve E\u011fitim Bir Sen Manisa 1 Nolu \u015eube Ba\u015fkan\u0131 Ahmet Yasav, E\u011fitim Bir Sen Manisa 2 Nolu \u015eube Ba\u015fkan\u0131 Bilal Elbir ve sendika \u00fcyeleri kat\u0131ld\u0131.<br \/>\n<br \/>Devlet Memurlar\u0131 Kanunundaki t\u00fcm haklara sahip olan \u00fcniversitelerin idari personelinin yer de\u011fi\u015fikli\u011fi hakk\u0131n\u0131n olmad\u0131\u011f\u0131n\u0131 ve ma\u011fduriyetin giderilmesi i\u00e7in bir araya geldiklerini anlatan E\u011fitim Bir Sen Manisa 2 Nolu \u015eube Ba\u015fkan\u0131 Bilal Elbir, &#8220;657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu\u2019na tabi olarak istihdam edilen \u00fcniversite idari personeli, kadro ve pozisyon unvanlar\u0131 itibar\u0131yla her bir \u00fcniversitede ayn\u0131 yeterlili\u011fe sahip olarak ayn\u0131 i\u015fi yapmalar\u0131na ra\u011fmen bakanl\u0131k ve ta\u015fra te\u015fkilat\u0131 bulunan di\u011fer merkez\u00ee kamu kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015fan idari personelin iller aras\u0131nda\/kurumlar aras\u0131nda yer de\u011fi\u015fikli\u011fine benzer bir merkez\u00ee yer de\u011fi\u015fikli\u011fi hakk\u0131nda sahip de\u011fildir. \u00dcniversite idari personelinin bir di\u011fer \u00fcniversiteye yer de\u011fi\u015fikli\u011fi yapabilmesi, kadrosunun bulundu\u011fu \u00fcniversitenin muvafakatine ba\u011fl\u0131d\u0131r. Bu muvafakatin verilmemesi uzun dava s\u00fcre\u00e7lerine neden olmakta; \u00e7o\u011fu durumda yer de\u011fi\u015fikli\u011fi yap\u0131lmak istenen \u00fcniversite, personel ihtiyac\u0131 i\u00e7in beklemek zorunda olmad\u0131\u011f\u0131 i\u00e7in lehe sonu\u00e7lanan muvafakat davalar\u0131 dahi sonu\u00e7 do\u011furamamaktad\u0131r. H\u00e2lihaz\u0131rda \u00e7o\u011fu \u00fcniversite, di\u011fer \u00fcniversitelere yer de\u011fi\u015fikli\u011fi yapmak isteyen idari personelinin bu taleplerini y\u00f6nergeler arac\u0131l\u0131\u011f\u0131yla d\u00fczenlemektedir. Bu y\u00f6nergelerde, yer de\u011fi\u015fikli\u011fi yapmak isteyen idari personel i\u00e7in asgari g\u00f6rev yapma s\u00fcresi, kadro unvan\u0131\/hizmet s\u0131n\u0131f\u0131 baz\u0131nda kontenjan, ge\u00e7erli mazeret vb. \u015fartlar aranmaktad\u0131r. Ancak bu y\u00f6nergelerin yeknesak olmad\u0131\u011f\u0131 ve uygulama birli\u011fi sa\u011flanamad\u0131\u011f\u0131 gibi di\u011fer \u00fcniversiteleri ba\u011flay\u0131c\u0131 h\u00fck\u00fcmler tesis edemedi\u011fi a\u00e7\u0131kt\u0131r. 2547 say\u0131l\u0131 Y\u00fcksek\u00f6\u011fretim Kanunu\u2019nun 52. maddesinin (f) bendindeki \u2018\u00fcniversitelerde g\u00f6revli memur ve di\u011fer g\u00f6revlilerin Y\u00fcksek\u00f6\u011fretim Kurulu Ba\u015fkan\u0131 taraf\u0131ndan y\u00fcksek\u00f6\u011fretim \u00fcst kurulu\u015flar\u0131 veya y\u00fcksek\u00f6\u011fretim kurumlar\u0131 aras\u0131nda atanabilecekleri\u2019 h\u00fckm\u00fc, \u00fcniversite idari personelinin \u00fcniversiteler aras\u0131nda yer de\u011fi\u015fikli\u011finin hukuki dayana\u011f\u0131n\u0131n mevcut oldu\u011funu ortaya koymaktad\u0131r.&#8221; dedi.<\/p>\n<p>&#8220;Fiili bir d\u00fczenleme yap\u0131lmas\u0131 gerekiyor&#8221;<br \/>\n<br \/>Sendikalar\u0131n\u0131n gayretleri sonucunda E\u011fitim, \u00d6\u011fretim ve Bilim Hizmet Kolu 6 ve 7. D\u00f6nem Kamu G\u00f6revlileri Toplu S\u00f6zle\u015fmesi\u2019nde idari personelin y\u00fcksek\u00f6\u011fretim kurumlar\u0131 aras\u0131nda yer de\u011fi\u015fikli\u011fi konusunda taraflarca \u00e7al\u0131\u015fma yap\u0131lmas\u0131n\u0131n kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131 ve bu kapsamda Y\u00d6K ve Cumhurba\u015fkanl\u0131\u011f\u0131 nezdinde \u00e7al\u0131\u015fmalar y\u00fcr\u00fct\u00fclse de hen\u00fcz i\u015fleyen bir sistem ortaya konulamad\u0131\u011f\u0131n\u0131 kaydeden Elbir, &#8220;Bu nedenle, \u00fcniversite idari personelinin \u00fcniversiteler aras\u0131 yer de\u011fi\u015fikli\u011fi i\u015flemlerinin, halen bir k\u0131s\u0131m \u00fcniversiteler taraf\u0131ndan yap\u0131lan, ancak h\u00e2liyle di\u011fer \u00fcniversiteleri ba\u011flamayan, m\u00fcnferit y\u00f6nergeler yerine toplu s\u00f6zle\u015fme h\u00fckm\u00fcnden hareketle Y\u00d6K Ba\u015fkanl\u0131\u011f\u0131 eliyle \u00fcniversiteler aras\u0131 merkez\u00ee yer de\u011fi\u015fikli\u011fine imk\u00e2n tan\u0131yacak \u015fekilde hukuki ve fiil\u00ee bir d\u00fczenleme yap\u0131lmas\u0131 gereklidir.&#8221; \u015feklinde konu\u015ftu.<\/p>\n<p>&#8220;Makam tazminat\u0131 hakk\u0131 \u00fcniversite daire ba\u015fkanlar\u0131na da verilmelidir&#8221;<br \/>\n<br \/>Daire ba\u015fkan\u0131 kadro \u00fcnvanl\u0131 kamu personeli aras\u0131nda kadrosunun bulundu\u011fu kamu kurumundan kaynakl\u0131 olarak \u00fccrette farkl\u0131l\u0131k getiren s\u00f6z konusu d\u00fczenlemelerin Anayasa\u2019n\u0131n 10 ve 55. maddelerine, kamu hizmetinin e\u015fit i\u015f yap\u0131larak verilmesine kar\u015f\u0131n, ayn\u0131 \u00fccreti alamayan \u00e7al\u0131\u015fanlar\u0131n motivasyon ve verimlili\u011fini olumsuz etkilemesi nedeniyle de \u00e7al\u0131\u015fma bar\u0131\u015f\u0131n\u0131n sa\u011flanmas\u0131n\u0131 \u00f6ng\u00f6ren Anayasa\u2019n\u0131n 49. maddesine, ayr\u0131ca \u0130nsan Haklar\u0131 Evrensel Beyannamesi\u2019nin 23\/2. maddesinde yer alan &#8220;e\u015fit i\u015fe e\u015fit \u00fccret&#8221; ilkesine ayk\u0131r\u0131 oldu\u011funu ifade eden Elbir, &#8220;Harcama sorumlusu olarak hukuki ve mali y\u00fck\u00fcml\u00fcl\u00fck alt\u0131nda bulunan \u00fcniversite daire ba\u015fkanlar\u0131n\u0131n \u00f6zl\u00fck haklar\u0131, g\u00f6rev, yetki ve sorumluluklar\u0131yla orant\u0131l\u0131 de\u011fildir. Merkez\u00ee idare daire ba\u015fkanlar\u0131na tan\u0131nan makam tazminat\u0131 hakk\u0131 \u00fcniversite daire ba\u015fkanlar\u0131na da verilmelidir.&#8221; dedi.<\/p>\n<p>&#8220;\u00d6\u011fretim elemanlar\u0131n\u0131n mali haklar\u0131 iyile\u015ftirilmelidir&#8221;<br \/>\n<br \/>\u00d6\u011fretim elemanlar\u0131, &#8220;e\u015fit i\u015fe e\u015fit \u00fccret&#8221; uygulamas\u0131 olarak bilinen 666 say\u0131l\u0131 KHK d\u00fczenlemesinde en fazla ihmal edilen kesim oldu\u011funu ve \u00fccretlerinde di\u011fer meslek gruplar\u0131yla orant\u0131l\u0131 bir art\u0131\u015f ger\u00e7ekle\u015fmeyen nadir meslek gruplar\u0131ndan biri oldu\u011funun alt\u0131n\u0131 \u00e7izen Elbir, &#8220;Bu durum, \u00fcniversite camias\u0131nda ve kamuoyunda \u00e7al\u0131\u015fma hayat\u0131ndaki kamu y\u00f6netimine ve adalete olan g\u00fcveni ciddi \u00f6l\u00e7\u00fcde zedelemektedir. Son y\u0131llardaki enflasyonist ortamda mali haklar\u0131nda reel bir art\u0131\u015f ger\u00e7ekle\u015fmeyen, aksine reel bir kay\u0131p ya\u015fayan \u00f6\u011fretim elemanlar\u0131\/akademisyenler, ciddi \u00f6l\u00e7\u00fcde itibar kayb\u0131na u\u011framaktad\u0131r. Akademik personelin, hem kendi i\u00e7inde hem de di\u011fer mesleklerle yap\u0131lan k\u0131yaslamalarda maa\u015f d\u00fczeyi ekseninde ma\u011fduriyet ve mali haklar bak\u0131m\u0131ndan da s\u0131n\u0131rl\u0131l\u0131k ya\u015fad\u0131\u011f\u0131n\u0131 s\u00f6ylemek yanl\u0131\u015f olmayacakt\u0131r. \u00dcniversitelerde g\u00f6rev yapan akademik personele y\u00f6nelik bir \u00fccret politikas\u0131n\u0131n olu\u015fturulmas\u0131 elzem olmakla birlikte, bu politikan\u0131n olu\u015fturulmas\u0131na ili\u015fkin s\u00fcrecin k\u0131sa s\u00fcrmeyecek olmas\u0131 ve akademik personelin k\u0131sa vadede maa\u015f iyile\u015ftirme beklentilerinin kar\u015f\u0131lanmas\u0131na ili\u015fkin gereklilik \u00e7er\u00e7evesinde belirli bir maa\u015f kalemi \u00fczerinden ge\u00e7mi\u015f d\u00f6nem kay\u0131plar\u0131n\u0131n telafisi ve k\u0131yaslanabilir meslek gruplar\u0131 ile e\u015fit ve adil bir d\u00fczeye y\u00fckseltmeye d\u00f6n\u00fck ad\u0131mlar\u0131n at\u0131lmas\u0131 \u00f6nem arz etmektedir. Bu itibarla \u00f6\u011fretim elemanlar\u0131n\u0131n mali haklar\u0131nda art\u0131\u015f sa\u011flanmas\u0131 y\u00f6n\u00fcnde bir d\u00fczenleme yap\u0131lmas\u0131 elzemdir.&#8221; \u015feklinde konu\u015ftu.<\/p>\n<p>&#8220;Ara\u015ft\u0131rma g\u00f6revlilerine ye\u015fil pasaport alabilme hakk\u0131 tan\u0131nmal\u0131d\u0131r&#8221;<br \/>\n<br \/>Ara\u015ft\u0131rma g\u00f6revlileri en fazla \u00fc\u00e7\u00fcnc\u00fc dereceye kadar ilerleyebildikleri i\u00e7in ye\u015fil pasaport alamad\u0131klar\u0131n\u0131 kaydeden Elbir, &#8220;Bu durumda ara\u015ft\u0131rma g\u00f6revlileri, yurt d\u0131\u015f\u0131 ara\u015ft\u0131rma, \u00e7al\u0131\u015fma, uluslararas\u0131 \u00e7al\u0131\u015ftay, sempozyum ve benzeri bilimsel toplant\u0131lara kat\u0131lmak i\u00e7in yurt d\u0131\u015f\u0131 \u00e7\u0131k\u0131\u015flar\u0131nda ye\u015fil pasaport alamad\u0131klar\u0131 i\u00e7in bu pasaportun sa\u011flad\u0131\u011f\u0131 kolayl\u0131klardan faydalanamamakta; bu ise uluslararas\u0131 nitelikteki bilimsel \u00e7al\u0131\u015fmalar\u0131n\u0131 sekteye u\u011fratmaktad\u0131r.
